The President of the Republic requested the Constitutional Court to exercise the preventive supervision of the constitutionality of rules contained in the bill that establishes the convergence of the regime of social protection for public servants with the general regime of social security.
Regarding this decision, the Presidency of the Republic publishes the following communiqué:
1. The President of the Republic requested m the Constitutional Court to exercise the preventive supervision of the constitutionality of rules contained in Parliamentary Decree No. 187/XII, which establishes the convergence of the regime of social protection for public servants with the general regime of social security.
2. In exact terms, the Constitutional Court was requested to express an opinion on the constitutionality of the following rules:
a) Rules that determine the 10% reduction of pensions under payment, as included in items a) and c) of § 1 of article no. 7;
b) Rules that determine the recalculation of the value of pensions under payment, as included in items b) and d) of § 1 of article no. 7;
3. The President of the Republic requested the Constitutional Court to check the consonance of these rules with the Country’s Basic Law, specifically in line with the principles of income tax unity, of contributory capability, of progressiveness and universality, and with the principle of the protection of trust, when taken jointly with the principle of proportionality
