The President of the Republic today requested that the Constitutional Court carry out a preventative check on the constitutionality of the law issued by Parliament which altered the legal system covering the non-compatibility and hindrances for the tenure of political or high public office.
This request for the check on constitutionality, by the President of the Republic, does not imply any judgement of merit over the inclusion of the members of the Parliaments of the Azores and Madeira in the system of non-compatibility and hindrances of the remaining holders of political office. That request solely results from the existence of grounded doubts as to the constitutionality of the law submitted for enactment, since the matter at issue appears to have the reserve characteristics of the Political and Administrative Statute of the Autonomous Regions, in accordance with the provisions of No. 7 of Article 231 of the Constitution.
