President of the Republic enacts bill altering legislation on companionate marriage

The President of the Republic enacted the Parliamentary bill that approved alterations to Law No. 7/2001, dated 11 May, which rules companionate marriage.

The bill that is now enacted arises in the sequence of an earlier bill covering the same matter that the President of the Republic returned to Parliament without enacting, on 24 August 2009, together with a Message (Click here to read the Message addressed to Parliament by the President).

The current text of the bill covers, in general, the objections raised by the President of the Republic in his Message of August 2009, as follows:

- the lack of opportunity to alter the juridical ruling of companionate marriage at the end of a Legislature, by not allowing the wide debate demanded by the bill’s relevance, an issue which has meanwhile been overcome;

- the need to ponder the rulings of patrimonial relationships that established a presumption of common ownership of assets and the rules covering joint and several liability for debts and envisaged the possibility of damage compensation in the case of the official ending of companionate marriage, which have now been disposed of.

It should once again be recalled that the enactment of a bill does not necessarily mean that the President of the Republic is in agreement with all the legal solutions therein contained.
