Note concerning the Parliamentary Bill which approves a set of additional measures on budgetary consolidation

The President of the Republic enacted today the Parliamentary Bill which approves a set of additional measures on budgetary consolidation.

Concerning this bill the Presidency of the Republic makes public the following note:

1 – The President of the Republic enacted today the Parliamentary Bill which “Approves a set of additional measures of budgetary consolidation which aim to strengthen and accelerate the reduction of the excessive deficit and to control the growth of public debt foreseen in the Plan for Stability and Growth (PSG)”.

2 – The President of the Republic took into consideration the urgency declared by the Government for this bill to enter into force, in order to reverse the situation of the public finances and reach, in the current year, a reduction in the budgetary deficit from 9.3% to 7.3% of the Gross Domestic Product, in line with the commitments assumed with community institutions and taking into consideration the need to counteract the turbulence which has affected the market for Portuguese public debt.

3 – However, since doubts have arisen as to the constitutionality of several of the fiscal precepts contained in the above bill, which must be clarified in the name of juridical safety and the confidence of the taxpayers, the President of the Republic will request from the Constitutional Court the successive supervision of the constitutionality of such provisions as soon as the bill is published and comes into force.

4 – As such, the Constitutional Court, in the exercise of its competency, will decide over the constitutionality of the said precepts in order that, with the briefness required by the unquestionable public interest in this issue, the doubts which have arisen with regard to the bill enacted today are definitively clarified.
