Communiqué from the Presidency of the Republic concerning the legislation that sets up the Sports Arbitration Tribunal

The Presidency of the Republic discloses the following communiqué on the bill that “Sets up the Sports Arbitration Tribunal and approves the respective legislation”:

1. The President of the Republic enacted today Parliamentary Decree no. 170/XII, which sets up the Sports Arbitration Tribunal and approves the respective legislation.

2. The enactment decision took into consideration that the issue dealt with in this Decree had already been the object of a decision of the Constitutional Court, following a request for the preventive supervision of its constitutionality.

3. However, since doubts subsist as to the constitutionality of the rules comprised in paragraphs nos. 1 and 2 of article no. 8 of the Decree, considering the right of access to the courts of law and an effective jurisdictional tutelage and equally as regards the referred decision of the Constitutional Court, the President of the Republic will request from this Tribunal, in the terms of item a) of §2 of article no. 281 of the Constitution, the abstract successive supervision of such rules.
