1. The President of the Republic requested today from the Constitutional Court the preventive inspection of two provisions contained in Parliamentary Decree No. 343/X, which authorizes the Government to legislate on urban rehabilitation.
2. The request for inspection of constitutionality is essentially based upon the circumstance that such provisions introduce, on the one hand, a regime of forced sale of real estate which is susceptible of infringing the right to hold private property consecrated in the Constitution and, on the other hand, not attributing to the lessees, in certain circumstances, the right to a fair compensation for urban measures with retroactive effects.
